This Privacy Policy explains how we collect, use, hold, disclose, and protect your personal information, and how you can access or correct it or make a complaint.

We handle personal information in accordance with the Privacy Act 1988 (Cth) (“Privacy Act“) and the Australian Privacy Principles (“APPs“). By providing your personal information to us or using our website and services, you agree to the handling of your information as described in this Policy.

1. What information we collect

The types of personal information we collect depend on how you interact with us. They may include:

  • Identity & contact details — your name, date of birth, postal address, email address, and phone number;
  • Emergency contact details — the name and contact details of a person to contact in an emergency;
  • Booking & participation information — the classes or services you book, attend, or enquire about;
  • Payment information — details needed to process payments (see section 8);
  • Health information — see section 2 below;
  • Website & technical information — such as your IP address, device and browser type, and how you use our website (see section 7); and
  • Communications — records of your enquiries, feedback, and correspondence with us.

2. Health & sensitive information

Because our services are physical fitness activities for older adults, we collect health information — for example medical conditions, injuries, mobility limitations, medications relevant to exercise, and information from any pre-exercise health screening or declaration. Health information is “sensitive information” under the Privacy Act and is given a higher level of protection.

We only collect health and other sensitive information where it is reasonably necessary for our services and, in general, with your consent. We use it solely to assess your suitability for activities, tailor and safely deliver our services, respond to incidents or emergencies, and meet our duty of care and legal obligations. We do not use or disclose your health information for any other purpose without your consent, unless required or authorised by law.

3. How we collect it

We collect personal information in a number of ways, including when you:

  • make an enquiry, booking, or registration through our website, by phone, by email, or in person;
  • complete a registration, health screening, or consent form;
  • make a payment for our services;
  • subscribe to our newsletter or marketing communications; or
  • visit or interact with our website (via cookies and analytics — see section 7).

Where reasonable and practicable, we collect personal information directly from you. Occasionally we may collect it from a third party — for example a family member, carer, referring health professional, or aged-care provider — where you have authorised this or it is otherwise permitted by law. If we receive information about you that we did not request, we will deal with it as required by the APPs.

4. Why we collect, hold & use it

We collect, hold, and use personal information to:

  • provide, manage, and improve our fitness services and programs;
  • process bookings, registrations, and payments;
  • assess health and suitability, and deliver services safely;
  • communicate with you, including sending confirmations, reminders, and responding to enquiries;
  • respond to incidents, injuries, or emergencies;
  • send you marketing and updates where you have not opted out (see section 6);
  • maintain records, and manage our business, insurance, and legal obligations; and
  • comply with applicable laws.

If you do not provide the personal information we request, we may not be able to provide our services to you safely or at all.

5. When we disclose your information

We do not sell your personal information. We may disclose it to:

  • our staff, instructors, and contractors, so they can deliver services to you;
  • third-party service providers who help us operate — for example booking, payment, email, IT, and website hosting providers — who are required to protect your information;
  • emergency services, medical practitioners, or your emergency contact, where necessary to respond to an incident or protect health or safety;
  • our professional advisers (such as accountants, insurers, or lawyers); and
  • government agencies, regulators, or others where required or authorised by law.

6. Marketing communications

We may send you news, offers, and updates about our services by email or other electronic means where you have consented or where it is otherwise permitted. We handle marketing in accordance with the Spam Act 2003 (Cth). Every marketing message includes an easy way to unsubscribe, and you can opt out at any time by using that link or by contacting us (see section 14). We will action opt-out requests promptly. We will not use your health or sensitive information for marketing.

7. Cookies & website analytics

Our website uses cookies and similar technologies, and analytics tools such as Google Analytics, to help the site function, remember your preferences, and understand how visitors use the site so we can improve it. This may involve collecting technical information such as your IP address, device and browser type, pages viewed, and referring pages.

Most of this information is aggregated or statistical. Third-party analytics providers may handle some of this data under their own privacy policies. You can set your browser to refuse or delete cookies, though some parts of the website may not work properly if you do.

8. Payments

Where you pay for services online, payments are processed by a third-party payment provider- Stripe / Square / PayPal/ Ezidebit. We do not collect or store your full card details on our systems — these are handled directly by the payment provider under their own terms and security standards (including PCI-DSS). We may retain records of the transaction (such as amount, date, and what it was for).

9. Overseas disclosure

Some of our service providers (for example cloud hosting, email, analytics, or payment platforms) may store or process information on servers located outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with the APPs. If you would like to know which providers we use and where they are located, please contact us.

10. How we store & protect your information

We take reasonable steps to protect personal information from misuse, interference, and loss, and from unauthorised access, modification, or disclosure. These steps include secure electronic storage, access controls and passwords, staff confidentiality obligations, and secure disposal of paper records.

We retain personal information only for as long as it is needed for the purposes described in this Policy or as required by law (for example, insurance, tax, or health-record retention obligations). When it is no longer required, we take reasonable steps to securely destroy or de-identify it. If we experience a data breach that is likely to result in serious harm, we will comply with the Notifiable Data Breaches scheme under the Privacy Act.

11. Accessing & correcting your information

You have the right to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant, or misleading. To make a request, contact us using the details in section 14. We will respond within a reasonable period. There is generally no charge for making a request, though we may charge a reasonable fee for giving access in some cases. If we refuse access or correction, we will tell you why in writing and how you can complain.

12. Complaints

If you believe we have breached the APPs or mishandled your personal information, please contact us first using the details in section 14 so we can try to resolve it. We will acknowledge your complaint and aim to respond within a reasonable time, usually within 30 days.
