Email Communication and Opt-In Consent 

By enrolling in this program, you consent to receive email communications from Strive Motion regarding program updates, class schedules, webinar links, promotions, and other relevant information. You may unsubscribe from promotional communications at any time; however, unsubscribing may prevent you from receiving important messages about registration openings, monthly webinar links, and changes to class venues or online formats. To unsubscribe, please email us directly. 

Programs Terms and Conditions  

By enrolling in any of our exercise programs (including but not limited to StediStrong, WAVES, Yoga, Zumba, and Online Classes), you agree to the following Terms and Conditions. Please read carefully before confirming your enrolment. 

  1. Enrolment and Payment Options

Our programs operate on a 10-week term basis (except WAVES – school terms only). You may choose one of the following payment options when enrolling: 

Option 1 – Annual Subscription (Pay for the Year) 

  • Covers five consecutive terms (four consecutive terms for Waves programs) of classes . 
  • Terms cannot be skipped or chosen out of order. 
  • Automatically renews every 12 months. 
  • Class Frequency 
    • StediStrong, Yoga, Zumba: One class per week per contract, excluding public holidays and the two-week break at the end of the year. 
    • WAVES: One class per week per contract during school terms, excluding public holidays. 
  • If you do not wish to continue for the following 12 months, you must notify us in writing by Week 3 of your last term in your contract. 
  • If written notice is not received by this date, your annual subscription will automatically renew and payment will be processed for the next annual cycle. 
  • Yearly fee is subject to change. You will be provided at least 30 days notice. 
  • No refunds or credits will be provided for missed sessions or withdrawal due to illness, injury, or change in circumstances. The discounted rate is offered in recognition of a full-year booking commitment. 
  • I understand that my card or bank details will be securely stored in the system to allow future payments to be processed. 
  • Public holidays are included within the term weeks; however, no classes are held on public holidays. 

 

Option 2 – Term Subscription (Auto-Debit Each Term) 

  • Allows you to pay per term via automatic (direct debit) deduction from your nominated credit card. 
  • Membership is for a fixed 10 week term. If a member joins partway through a 10-week term, your membership period will be deemed to have commenced at the start of the current term. 
  • Payments are processed automatically on Thursday of Week 4 each term for the following term. This date may change slightly, however, you will be notified prior.  
  • I understand that my card or bank details will be securely stored in the system to allow future payments to be processed. 
  • Class Frequency 
    • StediStrong, Yoga, Zumba: One class per week per contract, excluding public holidays. 
    • WAVES: One class per week per contract during school term, excluding public holidays. 
  • To opt out of future automatic payments, you must let Strive Motion know by Week 3 of the term via written notice (email). 
  • If written notice is not received, your next term’s payment will be processed, and your place in the class will be confirmed. 
  • No refunds or credits will be provided for missed sessions or withdrawal due to illness, injury, or change in circumstances. The discounted rate is offered in recognition of a full-term booking commitment, and your reserved place cannot be reallocated to another participant. 
  • Public holidays are included within the term weeks; however, no classes are held on public holidays. 
  • Subscription Fee is subject to change. You will be provided at least 30 days notice. 

 

Option 3 – Manual Term Payment 

  • Membership is for a fixed 10 week term. If a member joins partway through a 10-week term, your membership period will be deemed to have commenced at the start of the current term. 
  • Members may elect to enrol on a term-by-term basis. Enrolment for each term must be completed as the term approaches and may be processed either online or by contacting our reception team directly. 
  • Registrations open in Week 5 of each term. 
  • Your place in a class is only confirmed once payment has been received in full. 
  • Your position in the class will be held for a maximum period of two (2) weeks once registrations open in Week 5. If you do not complete your enrolment within this timeframe, your position may be released and offered to another participant for the following term. 
  • No refunds or credits will be provided for missed sessions or withdrawal due to illness, injury, or change in circumstances. This rate is offered in recognition of a full-term booking commitment, and your reserved place cannot be reallocated to another participant. 
  • Public holidays are included within the term weeks; however, no classes are held on public holidays. 

 

Option 4 – Book in Each Week (only available in certain areas) 

  • You may book in weekly if you prefer flexibility or would like to attend extra classes occasionally. 
  • Your spot is not guaranteed until your booking and payment have been completed. 
  • Weekly booking spots open 7 days prior to each class. 
  • Availability is first come, first served, and weekly bookings may not always be available for all classes. 
  • No refunds or credits will be provided for missed sessions or withdrawal due to illness, injury, or change in circumstances. Your reserved place cannot be reallocated to another participant. 

 

  1. General Payment Conditions
  • All classes must be paid in full before you can attend. 
  • No refunds, credits, or transfers will be issued once payment has been made, regardless of attendance, withdrawal, or changes in personal circumstances. 
  • Processing fees may apply depending on your chosen payment method. 
  • Failure to make payment by the due date may result in forfeiture of your place in the class. 
  • Prices and payment schedules are subject to change, but you will be notified in advance of any adjustments. 
  • By selecting a subscription option, you authorise automatic deductions from your nominated account as per your chosen payment schedule. 
  • Each term runs for a fixed 10 weeks (excl WAVES- school terms only). Note public holidays are included within the term weeks; however, no classes are held on public holidays. 
  • Classes are not held on public holidays, and there are no refunds, or credits for those days. 
  • There are no make-up classes and class days/times cannot be changed once a term has started. 
  • If available, free trials are offered exclusively to new participants only and are limited to one per individual. 
  • By joining a free trial, you confirm that you are physically able and have obtained medical clearance from your General Practitioner to participate. You accept full responsibility for your own health and safety and waive all liability against Strive Motion and its staff for any injury or loss incurred. 
  • StediStrong members only: If your venue is unavailable on a particular day (e.g. school holidays, maintenance, or unexpected closures), your session will move online. 

 

 

  1. Health and Safety Requirements

To ensure the safety of all participants, you agree to: 

  • Obtain medical clearance to exercise if you have any existing health conditions, recent health changes, or hospital admissions. 
  • Not attend class until you have been cleared (if required) to exercise and our office has confirmed receipt of your clearance. 
  • Inform instructors or program staff immediately of any change in your health status that may impact your ability to safely exercise (e.g., pain, dizziness, falls, surgery, or new diagnoses). 
  • Provide updated medical clearance when requested or when your health status changes. 
  • Understand that participation is subject to ongoing assessment by program staff for safety and suitability. 
  • Strive Motion reserves the right to discontinue participation if it becomes unsafe for you or other participants. 
  • Strive Motion reserves the right to request further medical clearance at any time if program staff believe you may not be suitable to participate in a class without additional medical approval. 
  • Acknowledge that you are able to follow the instructions provided by the instructor and/or program guidelines for the safe and effective participation in all classes. 
  • Acknowledge that the Program is not an acute service and that messages or emails may take up to 3 business days to receive a response. 

 

  1. Conduct and Behaviour

Participants agree to: 

  • Arrive on time and behave respectfully toward instructors, staff, and other participants. 
  • Notify Program staff of any health changes that could affect participation. 
  • Provide up-to-date contact information (email and mobile) to receive important communication regarding class changes. 
  • Understand that community venues are not managed by the Program. Any venue issues should be directed to venue staff, while Occupational Health and Safety concerns will be noted by Program staff. 

 

  1. Class Information

Class Duration: 

  • StediStrong classes: 1 hour (including setup and pack down), with approximately 45–50 minutes of exercise. 
  • Yoga, Zumba, and WAVES classes: 45 minutes. 
  • Online: 50 minutes 

Program Details: 

  • StediStrong classes include strength (dumbbells, TheraBands), balance training, and flexibility. 
  • Bring your own equipment, except for classes held in Sutherland Shire, St George, and Bayside LGAs, where equipment is provided. 
  • Equipment required: 1-2 sets of dumbbells, and a TheraBand. 
  • Maximum capacity: 13–30 participants (depending on venue). 
  • WAVES classes are gentle warm-water exercise, not hydrotherapy. (Only available in Eastern Suburbs) 
  • Pool temperature ranges between 27–35°C. 
  • Maximum capacity: 15 participants. 
  • Online classes: 
  • Participants must provide their own equipment and ensure a safe, hazard-free space. 
  • Instructors cannot always see you, so please exercise safely. 
  • Participants are responsible for their own technology setup (Microsoft Teams or Zoom). 
  • The Program does not provide IT support. 
  • Ensure that a friend or family member is aware you are exercising at all times. The instructor may not be able to see if you are unwell or if an injury occurs. 

 

  1. Class Changes and Cancellations
  • In rare cases, a class may be cancelled due to venue or staffing issues. 
  • While every effort is made to maintain consistency, the Program reserves the right to adjust venues, instructors, or schedules as needed. 
  • Your place in a class cannot be held for future terms if you do not pay for the current one. 
  • Instructors may change without notice, and multiple instructors may teach across a single term. 
  • Classes may be moved to an online format in the event of restrictions on venue availability, instructor staffing, or other unforeseen circumstances. 

 

  1. Data Protection and Privacy
  • Strive Motion is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). 
  • By enrolling in our programs, you agree that we may collect, store, and use your personal information for the purposes of: 
  • administering your enrolment, payments, and attendance; 
  • communicating program updates, class changes, or promotions; 
  • complying with legal obligations. 
  • We will take all reasonable steps to ensure your personal information is stored securely and is protected from misuse, interference, loss, or unauthorised access, modification, or disclosure. 
  • You have the right to request access to, or correction of, your personal information held by Strive Motion. If you have any concerns or wish to make a complaint regarding the handling of your personal information, please contact us at admin@strivemotion.com.au. 
  1. Gift Cards
  2. Validity and Expiry
  • All gift cards are valid for 3 years from the date of purchase, in accordance with Australian Consumer Law. 
  • The expiry date will be clearly displayed on the gift card or within the purchase confirmation email. 
  • After the expiry date, the card cannot be used and any remaining balance will be forfeited. 
  1. Usage
  • Gift cards can be redeemed for Strive Motion programs, classes, memberships, or services available through Mindbody, unless otherwise stated. 
  • Gift cards cannot be used for cash withdrawals, exchanged for cash, or refunded. 
  • If the total purchase exceeds the value of the gift card, the balance must be paid using another accepted payment method. 
  • Multiple gift cards may be used in a single transaction, provided sufficient balance is available. 
  • Gift cards may be used online (through the Mindbody portal) or over the phone for participating Strive Motion locations. 
  1. Balance and Tracking
  • Balances can be checked via your Mindbody account or by contacting our office. 
  • Each gift card carries a unique code which must be presented at the time of redemption. 
  • Treat your gift card like cash — lost, stolen, or damaged cards will not be replaced or refunded. 
  1. Restrictions for gift cards
  • Gift cards cannot be reloaded or topped up. 
  • Gift cards cannot be transferred to another account or participant once redeemed. 
  • Promotional or complimentary gift cards may have different terms or shorter expiry periods, which will be stated at the time of issue. 
  1. Refunds and Exchanges
  • All gift card purchases are final. No refunds or exchanges will be provided once payment has been processed. 
  • No change will be given for transactions made using a gift card; any remaining balance will stay on the card until expiry. 
  1. Technical Issues
  • In the unlikely event of a technical issue or error with a digital gift card, please contact admin@strivemotion.com.au. We will verify the purchase and issue a replacement if valid and unused. 
  1. Amendments
  • Strive Motion reserves the right to amend these terms at any time, provided that such changes do not affect gift cards already purchased. Updated terms will be published on our website. 

 

  1. Referring a Friend
  • A “Refer a Friend” promotion is available only when expressly stated by Strive Motion. Referrals are open to new participants only. 
  • To be eligible for any reward, you must follow the official “Refer a Friend” process at the time of referral. 
  • This offer does not apply to friends referred prior to the promotional period. 
  • Any rewards or incentives offered are non-transferable and not redeemable for cash. 
  • Strive Motion reserves the right to modify or cancel referral offers at any time. 

 

  1. Acknowledgement of Risk and Release of Liability

By participating in any Strive Motion program, I understand and agree to the following: 

  • I voluntarily assume all risks associated with exercise and physical activity, including but not limited to injury, illness, falls, or aggravation of existing medical conditions. 
  • I confirm that I am responsible for my own health and that I am physically able and medically cleared to participate in exercise activities. 
  • I release and hold harmless Strive Motion, its staff, instructors, contractors, venue partners, and any affiliated personnel from any liability, claim, or demand arising out of my participation in the program. 
  • I agree to be well hydrated, adequately nourished, and to have taken any prescribed medications at the appropriate times prior to participating in Strive Motion classes. 
  • I agree to follow all safety instructions provided by instructors and program staff and to inform Strive Motion of any changes in my health or medical condition that may affect my ability to participate safely. 
  • I agree that, in the event of any change to my health status, I will obtain medical clearance from an appropriate medical practitioner before returning to class. I understand that it is my responsibility to ensure I am medically fit to resume participation and that I will not attend classes until I have been cleared to do so. 
  • In the event of an emergency, I consent to receive medical attention deemed necessary and accept full responsibility for any associated costs. 
  • I acknowledge that participation in exercise activities is undertaken at my own risk, and I accept full responsibility for any consequences that may arise from my involvement. 
  • I understand that this waiver is legally binding, and by agreeing electronically or physically, I waive certain legal rights, including the right to sue, and fully agree to the terms outlined. 

 

  1. Agreement and Acknowledgement

By signing up to our programs and submitting your enrolment, you confirm that you: 

  • Have read, understood, and agree to all Terms and Conditions, including the payment terms. 
  • Confirm you are medically safe to participate, or have provided medical clearance if required. 
  • Understand that no refunds, credits, or transfers are available. 
  • Authorise automatic payments where applicable and accept responsibility for providing timely notice for cancellation or opt-out requests. 
  • Acknowledge that participation is at your own risk and that you will follow all safety instructions provided.
